Based on the executive approval of a notary, the State Enforcement Service (i.e. a rayon department of SES) initiates enforcement proceedings and a court/enforcement officer conducts a forceful repossession of the leased asset from the debtor.
Enforcement officer conducts his/her enforcement actions at the place of debtor’s residence or work, or in the location of the debtor’s property. Where a debtor is a legal entity, the enforcement actions take place where the debtor has its permanently operating representation or property located. The claimant may choose among several locations for enforcement of his/her rights, between several departments of SES, authorized to enforce court decisions on their respective territories (article 20, Law of Ukraine "On Enforcement Proceedings").
A court/enforcement officer shall enforce the decision under which the debtor is required to do certain things, exactly in the place where these things should be done.
Executive approval may be presented for enforcement within one year, beginning from the next day after its issue (article 21 of the Law "On Enforcement Proceeding").
